ProfitSharks Terms of Use

These Terms of Use apply to the online analytics service ProfitSharks, operated and owned by MTSS Development OÜ (company registration number: 16834523), incorporated in Estonia.

Throughout these Terms, "ProfitSharks", "we", "us", and "our" refer to MTSS Development OÜ.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Introduction

ProfitSharks is a cryptocurrency analytics platform used for portfolio insights, performance metrics, and trading history analysis.

2. Definitions

  • User - an individual or legal entity that registers an account and uses the Service.
  • Account - a user profile providing access to the Service.
  • Service - the ProfitSharks platform and its cryptocurrency analytics features.
  • Subscription - a paid plan that grants access to Service features.
  • Content - any data processed in the platform, including analytics and API data.

3. Eligibility

By using the Service, you confirm that you have legal capacity. If acting on behalf of an organization, you confirm you are authorized to do so.

4. Data and Privacy

ProfitSharks collects the following data:

  • Account data - email, nickname
  • Technical data - IP address, browser, device information
  • Exchange API data - read-only portfolio and trading data
  • Usage logs - actions performed within the platform

API keys must be connected with read-only permissions. ProfitSharks never requests withdrawal or trading permissions. Keys are encrypted and may be removed by the user at any time.

Data processing is governed by the Privacy Policy.

5. Account Registration and Security

You must provide accurate account information and protect your login credentials. You are responsible for all activity under your account. Account sharing is prohibited.

6. Permitted Use

Users agree to:

  • Use the Service lawfully
  • Analyze only their own portfolio data
  • Comply with exchange and regulatory rules

Users must not:

  • Attempt to access other users’ data
  • Use bots, scrapers, or scripts to disrupt the Service
  • Reverse-engineer, copy, or duplicate the platform
  • Use the Service to provide competing analytics products without permission

ProfitSharks does not provide investment or financial advice.

7. Third-Party Services and APIs

ProfitSharks relies on exchange APIs. We are not responsible for:

  • Exchange outages or API failures
  • Incorrect or delayed market data
  • User misconfiguration of API permissions

8. Subscription, Payments, and Refunds

Advanced features may require a paid Subscription. Subscriptions renew automatically unless canceled before renewal. Payments are processed securely by third-party providers.

All payments are final and non-refundable, except where required by law or if a verified technical failure is confirmed.

9. Intellectual Property

Users receive a limited, non-exclusive, non-transferable right to use the Service.

Users may not copy, resell, reverse-engineer, or exploit any part of ProfitSharks without written permission.

10. Community Participation

Users are responsible for content they post in discussion channels. ProfitSharks may remove harmful or misleading content.

11. Disclaimer and Limitation of Liability

The Service is provided on an "as-is" basis. ProfitSharks is not liable for trading losses, data inaccuracies, exchange issues, system downtime, or indirect damages.

12. Termination

ProfitSharks may suspend or terminate accounts in cases of fraud, abuse, or violation of these Terms. Termination does not entitle the user to a refund.

13. Changes to Terms

ProfitSharks may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
